Terms of Service

Thank you for choosing Kulohi.

Kulohi was created to help people preserve memories, strengthen relationships, and build lasting legacies through meaningful conversations, stories, and shared experiences. These Terms of Service (“Terms”) explain the rules that govern your use of Kulohi and describe the rights and responsibilities of both you and Gremlin Labs LLC.

By creating an account, accessing, or using Kulohi, you agree to these Terms. If you do not agree, please do not use the Service.

Gremlin Labs LLC, doing business as Kulohi (“Gremlin Labs,” “Kulohi,” “we,” “our,” or “us”), operates Kulohi.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account unless permitted by applicable law and authorized by a parent, guardian, or other legally authorized representative.

By using Kulohi, you represent that you have the legal authority to enter into this agreement.

You are responsible for:

- Providing accurate account information. - Maintaining the security of your login credentials. - Keeping your contact information up to date. - Promptly notifying us of any unauthorized use of your account.

You are responsible for all activity that occurs under your account unless caused by our negligence or a security incident within our systems.

Paid checkout is closed during the current Kulohi beta. No payment or billing cadence is collected when someone requests beta access. The prices and billing terms below describe the intended paid membership. The complete terms that apply to a purchase will be shown before anyone is asked to pay.

Kulohi intends to offer one paid membership with the same included experience at either:

- $49 each month; or - $499 each year, which saves $89 compared with twelve monthly payments.

Both choices provide the same membership. Kulohi does not use feature tiers or a separate Founding price. The full charge, billing frequency, renewal terms, and included experience will be shown before checkout.

When paid checkout opens, and unless the checkout terms state otherwise:

- Memberships automatically renew. - You may cancel renewal at any time. - Cancellation prevents future renewals but does not typically provide refunds for the current billing period, except as described in our Refund Policy or where required by law.

Kulohi does not currently offer a free trial or a paid checkout. The published Refund Policy describes an intended 30-day Robin Promise for a member's first paid membership. Its operating process and final terms must be available before paid checkout opens.

Founding Membership is recognition for the first 1,000 Kulohi members, not a separate pricing or feature tier. Founding recognition does not change product permissions. A Founding Member's original monthly and annual prices remain locked while that membership remains continuously active; canceling or allowing the membership to lapse ends the price lock.

From time to time, Kulohi may offer beta or early-access features.

Beta features:

- May change or be discontinued. - May contain bugs or incomplete functionality. - May not perform as expected. - Are provided to help improve Kulohi before broader release.

Your feedback helps us improve these experiences.

Robin is an AI-powered companion designed to assist with conversation, organization, reminders, and preserving memories.

Robin is intended to support - not replace - human judgment, professional advice, or emergency services.

Robin may occasionally:

- misunderstand requests, - generate inaccurate information, - provide incomplete responses, - forget context, - make mistakes.

You remain responsible for decisions you make based on Robin’s responses.

You retain ownership of the content you create or upload to Kulohi, including:

- stories, - photographs, - recordings, - journals, - conversations, - documents, - captions, - notes.

By using Kulohi, you grant Gremlin Labs a limited, non-exclusive license to host, store, process, back up, organize, and display your content solely as necessary to provide the Service.

We do not claim ownership of your memories or personal content.

Kulohi allows members to preserve selected stories and photographs and includes a printed Legacy Book benefit. Under the controls available in the current beta, the book may contain only stories and images the member approved for Legacy. Private Robin conversations cannot currently be added. One printed book is included after 12 completed months of paid service. If the member passes before reaching 12 completed months, the book is available for $15.

The current beta does not yet provide complete self-service Legacy Preferences, Legacy Contact designation, incapacity or death verification, post-account transfer, revision, delivery-tracking, or international-fulfillment controls. Requesting beta access does not begin paid service or the 12-month eligibility period.

If future Legacy controls become available, Kulohi will identify them in the product and explain the terms that apply before recording a member's choices. Those controls may address:

- eligible content; - member-directed privacy, export, transfer, and deletion choices; - separately designated trusted people; - verification requirements; and - applicable law.

Kindred participation, payment for another person's membership, ordinary conversation, or a support request does not create Legacy authority or grant access to private Robin conversations. A printed book does not change those boundaries. The current status and safeguards are described in our Legacy Features Policy and Development Notice.

You may invite trusted individuals into Kindred.

You are responsible for selecting the permissions granted to each Kindred member.

Kulohi will honor the permissions you configure, but we cannot verify the ongoing personal relationships between members of your Kindred space.

You should review and update Kindred permissions whenever your circumstances change.

You agree not to:

- violate any applicable law; - attempt unauthorized access to Kulohi or other accounts; - upload malicious software or harmful code; - interfere with the operation or security of the Service; - impersonate another person; - infringe upon intellectual property rights; - use Kulohi to harass, threaten, exploit, or harm others; - use automated systems to abuse or overwhelm the Service.

Additional expectations are described in our Acceptable Use Policy.

Kulohi, Robin, the Kulohi name, logos, software, designs, interfaces, graphics, and related materials are owned by or licensed to Gremlin Labs LLC and are protected by applicable intellectual property laws.

These Terms do not grant ownership of Kulohi itself.

Kulohi relies on trusted third-party providers for services such as authentication, cloud hosting, artificial intelligence, payment processing, analytics, and communications.

Your use of those services may also be subject to their respective terms and privacy practices.

We strive to make Kulohi available whenever you need it.

However, we do not guarantee uninterrupted availability.

We may temporarily suspend access for:

- maintenance, - security updates, - infrastructure improvements, - legal compliance, - or unexpected outages.

Kulohi will continue to evolve.

We may:

- introduce new features, - modify existing functionality, - improve Robin, - retire older features, - adjust membership offerings.

Whenever practical, we will provide reasonable notice of significant changes.

We may suspend or terminate accounts that:

- violate these Terms, - engage in fraudulent activity, - threaten the security of Kulohi, - misuse the Service, - violate applicable law.

Members may also close their accounts at any time.

Termination does not automatically remove information that we are legally required to retain. Current retention and deletion practices are described in the Privacy Policy. Kulohi does not currently preserve or transfer content based on Legacy settings that a member could not actually configure.

Kulohi is provided on an “as available” and “as is” basis to the extent permitted by applicable law.

While we work hard to provide a reliable and thoughtful experience, we cannot guarantee that:

- Robin will always be correct; - every feature will always be available; - conversations will always be uninterrupted; - memories will never be accidentally lost due to circumstances beyond our reasonable control.

Members should maintain independent backups of any irreplaceable information.

To the fullest extent permitted by law, Gremlin Labs LLC shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of Kulohi.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

You agree to indemnify and hold harmless Gremlin Labs LLC from claims arising from your misuse of Kulohi, your violation of these Terms, or your infringement of another person’s rights.

These Terms are governed by the laws of the State of Michigan, United States, unless otherwise required by applicable law.

Any disputes shall be resolved in the appropriate courts located within Michigan unless another venue is required by law.

We may update these Terms as Kulohi grows.

When material changes are made, we will update the “Last Updated” date and, where appropriate, provide additional notice.

Continued use of Kulohi after updated Terms become effective constitutes acceptance of those changes.

Kulohi text notifications are optional. If you affirmatively enroll, you agree to receive recurring informational text messages from Kulohi, including account notifications, reminders, and updates you have chosen to receive. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help, or contact support@kulohi.com. Consent is not a condition of purchase.

Providing a phone number, creating an account, joining Kindred, accepting another notification permission, or being included in a member's sharing choices does not by itself enroll you in text messages. A member's permission to share an update and a recipient's consent to receive that update by SMS are separate choices.
